Scope of Services: Ghost Graphics provides digital marketing, branding, and design services to clients worldwide. Our services include but are not limited to logo design, website development, social media marketing, graphic design, print design, packaging design, and AI solutions. The scope of each project will be defined in a separate agreement or proposal document. We reserve the right to refuse service to any client whose project we deem to be in conflict.
Payment Terms: All payment terms will be discussed and agreed upon prior to the start of any project. A deposit may be required before work can commence. Payments must be made in full for completed work before delivery of any final files or designs. Failure to make payments on time may result in a delay in the delivery of work.
Intellectual Property: All work produced by Ghost Graphics remains the intellectual property of Ghost Graphics until payment has been made in full. Once payment has been received, clients will have full ownership of the designs and files. Ghost Graphics reserves the right to use the designs and files produced for promotional purposes, unless the client requests otherwise in writing.
Confidentiality: Ghost Graphics recognizes that our clients may provide confidential information during the course of a project. We agree to keep all client information confidential and will not share or disclose any such information without the client's prior written consent. However, Ghost Graphics reserves the right to use non-confidential aspects of the project as part of our portfolio or promotional materials.
Revisions: Ghost Graphics offers a specified number of revisions as outlined in each project's scope of work. Any additional revisions beyond the agreed upon number will incur an additional fee. The number of revisions is based on the initial agreement or proposal document and any changes must be approved by both parties in writing.
Termination: Either party may terminate a project at any time with written notice. Ghost Graphics will invoice for all work completed up until the termination date. If a deposit has been made, it may be non-refundable. If a project is terminated due to a breach of this agreement by either party, the non-breaching party may pursue legal action to recover damages.
Limitation of Liability: Ghost Graphics is not liable for any direct, indirect, or incidental damages resulting from our services or the use of our designs. We will not be held responsible for any loss of profits, revenue, or data as a result of our work. The client agrees to indemnify and hold Ghost Graphics harmless from any claims, losses, damages, or expenses arising out of or in connection with our services.
Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the state/country where Ghost Graphics is located. Any legal disputes arising from this agreement will be resolved in accordance with the laws of the state/country where Ghost Graphics is located.
Amendments: Ghost Graphics reserves the right to amend these terms and conditions at any time without prior notice. Any changes will be posted on our website and will become effective immediately upon posting. Clients are advised to review the terms and conditions periodically for any changes.
